Bredin Prat is advising the consortium formed by Fortress Investment Group and Davidson Kempner Capital Management, as well as Fortress Investment Group itself, in connection with the financial and corporate restructuring of Société Phocéenne de Participation (SPP), the holding company of the BOURBON group and its relevant subsidiaries.

Pursuant to a decision issued by the Marseille Commercial Court on July 17, the accelerated safeguard plans of Société Phocéenne de Participation and certain of its subsidiaries were approved, enabling a significant reduction in financial debt and providing new financing.

In this context, Davidson Kempner Capital Management and Fortress Investment Group, already committed alongside BOURBON, are set to become the Group’s new controlling shareholders following the implementation of the financial restructuring planned by the end of 2025.
