Infrastructure under pressure with the Green Transition

Making infrastructure greener is now at the heart of public policies for the Green Transition. This “necessary revolution” is no longer merely a political option, but an obligation to act, already enshrined in the case law of the French Council of State (Conseil d’Etat, 24 October 2025, no. 467982, Commune de Grande-Synthe) and the European Court of Human Rights (ECHR, Grand Chamber, 9 April 2024, no. 53600/20, Verein KlimaSeniorinnen Schweiz). This development was reinforced by a landmark advisory opinion of the International Court of Justice dated 23 July 2025, which establishes that the failure by States to fulfill their obligations in respect of climate change in fact constitutes an internationally wrongful act.
