The Court of Cassation notes that access to connection data obtained by the AMF under the previous law (without prior authorization) is unlawful only if the factual grounds justifying the necessity of such an investigative measure are not sufficiently serious, which must be assessed by taking into account, in particular, the criminal penalties involved.
