In two decisions both dated 18 February 2026, the French Transport Regulatory Authority (“ART”) settled two disputes, one between RATP Smart Systems and Île-de-France Mobilités (“IdFM”) and the other between SNCF Connect and IdFM, regarding the digital distribution of public transport tickets in the Île-de-France/Paris region. In these decisions, the ART enshrines a right to remuneration for multimodal digital services (“MDS”), prohibits preferential treatment for IdFM’s internal MDS, requires the protection of third-party MDS commercial data, and qualifies Apple’s Wallet as an MDS. Beyond the Île-de-France/Paris region case, the ART reiterates that opening the market to competition requires viable economic conditions and non-discriminatory contractual terms for new entrants, and confirms dispute resolution as a central instrument of sectoral regulation.
