Does the principle of fairness (still) exist in the law of evidence?

Read the contribution by Jean-Daniel Bretzner, partner in the Litigation Department, which appears in the collective work published by Lefebvre Dalloz in honor of Professor Xavier Henry, whose remarkable work has greatly contributed to the reputation of the Nancy School of Law. The title of this collectif work is: “Le droit tout en finesse.” Jean-Daniel Bretzner’s article, meanwhile, focuses on a topical question: “Does the principle of fairness (still) exist in the law of evidence?” More
