Interpretation of the “Macron Scale” of unfair dismissal compensation: important insights

Seven years after being passed into law, the “Macron” Scale is still making headlines across the French legal landscape.

An April 29 French Supreme Court ruling has provided important guidance regarding the application of the scale.

This much needed clarification will be of great use to companies with fewer than 11 employees, from small businesses to holding entities.

In these types of companies, it is now clear that:

  • The minimum amount of compensation is 3 months of salary for employees with 11 or more years of service;
  • Caps of between 1 and 20 months of salary based on years of service remain in place. Read more
