Directive (EU) 2024/1619 (CRD VI), transposed into French law by Ordinance no. 2026-255 of 8 April 2026 and a decree dated 24 April 2026, embodies the European legislator’s commitment to further reinforce harmonisation of the EU prudential framework. The new rules, whose implications for banking governance were examined in our previous article, aim to reduce differences in national practices and the resulting fragmentation within the internal market. This second article focuses on another central aspect of the reform: the bolstering of prudential supervisory powers, resulting in increased reporting requirements and greater oversight by the competent authorities of certain structuring transactions, adjustments to sanctioning powers and the overhaul of the supervisory framework for third-country branches.
